Terms and Conditions for Yudu powered by Thynker Tech
1. Introduction
Welcome to Yudu, a software service provided by Thynker Tech designed specifically for children in the K-6 educational system, their parents, and teachers. These Terms and Conditions ("Agreement") govern your use of the Yudu platform ("Service"). By accessing or using the Service, you agree to comply with and be bound by this Agreement. If you do not agree with any part of these terms, please do not use the Service.
2. Jurisdiction
This Agreement is governed by and construed in accordance with the laws of Singapore. Any disputes arising out of or related to the use of the Service shall be subject to the exclusive jurisdiction of the courts located in Singapore.
3. User Obligations
3.1 General Usage
- Users must provide accurate and complete information during registration and maintain their account to ensure that the information remains accurate and up-to-date.
- Users agree to use the Service only for lawful and educational purposes.
- Unauthorized use of the Service, including unauthorized access to our systems, misuse of passwords, or any information posted on the Service, is strictly prohibited.
3.2 Children
- Users under the age of 18 must have permission from their parents or legal guardians to use the Service.
- Parents or guardians are responsible for monitoring their children's use of the Service and ensuring that it is used appropriately.
3.3 Educators
- Teachers and other educational professionals using the Service must obtain appropriate consent from the parents or guardians of the children before allowing them to use the Service.
- Educators agree to use the Service in a manner that supports student learning and wellbeing.

4.1 Data Collection

4.2 Parental Consent
- For children under 13, we require verifiable parental consent to collect, use, or disclose personal information.
5. Intellectual Property
- All graphics, videos, lesson plans, educational materials, and other assets provided through the Service are the sole property of Thynker Tech and are protected by copyright laws. Unauthorized use or reproduction of these materials is strictly prohibited and may result in legal action.
- All content on Yudu (including graphics, text, interfaces, and software) is owned by Thynker Tech and protected by copyright and intellectual property laws of Singapore and international agreements.
- Users are granted a non-exclusive, non-transferable, revocable license to use Yudu solely for educational purposes.
5.1 Use of Content
- Modification, distribution, or sale of any content from our Service is prohibited without prior written permission from Thynker Tech.
6. Dispute Resolution
- All disputes arising out of or relating to this Agreement or the use of the Service shall be resolved in the courts of Singapore.
- All disputes will be subject to the exclusive jurisdiction of the courts of Singapore.
7. Termination Conditions
- Thynker Tech reserves the right to suspend or terminate your access to the Service at any time without notice, for any reason, including but not limited to:
- Breach of this Agreement
- Abusive behavior
- Foul play
- At any time, without notice, for any other reason at the discretion of Thynker Tech.
8. Recurring Payments and Authorization
- Parents, educators, or guardians agree to recurring payment terms when purchasing subscriptions or additional features
- Authorization for automatic payments can be revoked at any time through written notice or through the designated user interface.
- By agreeing to recurring payments, the cardholder authorizes PayMongo to automatically deduct payment from the given credit/debit card account until he/she revokes such authorization. The payments shall be charged at the start of each billing cycle, which shall be dependent on the agreed products/plans. After the processing of payment, the Merchant shall reach out to the cardholder if his/her payment is successful or not. PayMongo shall not be held liable for the Merchant's failure to notify the cardholder regarding the payment status. The cardholder further acknowledges and agrees that the billing cycle and amount to be deducted are dependent on the instructions made by the Merchant to PayMongo.
9. Parental Controls
We encourage parents to use appropriate parental controls and monitoring tools to oversee their children's online activities, including their use of the Yudu platform.
10. Modifications to Service and Agreement
Thynker Tech reserves the right to modify, suspend, or discontinue the Service at any time without prior notice. Additionally, we may update this Agreement from time to time to reflect changes in our practices or to ensure compliance with legal requirements. Your continued use of the Service after any modifications to this Agreement will constitute your acceptance of such changes. These terms may be updated or modified occasionally to meet legal, technological or operational changes. Users will be notified of significant changes; however, regular review of these terms is encouraged.
